UB-083 (7-79) ARIZONA DEPARTMENT OF ECONOMIC SECURITY Unemployment Insurance
CLAIMANT: Richard GUTHRIE SSN: 504 18 52 90 DATE: 1-14-80
Thank you for your reply to our Notice to Employer, UB-110, which informed you that the above claimant has filed a claim for Unemployment Insurance.
* 1. [ ] Notice of this claim was sent to you on ________ Your protest was postmarked ________ which is not within the ten-day period specified in the Law. Since your protest was untimely, you will not be considered an interested party to any action taken.
2. [ ] Notice that a claim has been filed is mailed to any employer shown by the claimant as his last employer, regardless of whether the employer is subject to the Employment Security Law of Arizona. To assure that Unemployment Insurance payments are made only to eligible claimants, we must have complete information as to the reason the claimant is no longer employed.
3. [ ] The claimant did not qualify for Unemployment Insurance; therefore, we are closing our files on this claim.
* 4. [X] No determination will be issued as the period covered by vacation and/or sick leave pay is not in a period for which benefits are claimed.
5. [ ] We will not issue a determination at this time as this claimant has not continued to file for Unemployment Insurance.
* 6. [X] The information you furnished does not indicate that the claimant separated from your employ for any reason which would require us to issue a determination on the claimant's eligibility, or the information is not sufficiently detailed for us to determine whether the claimant separated from your employ for one of the reasons shown on the reverse. If you are subject to Unemployment Insurance taxes in Arizona, your experience rating account will be charged for its proportionate share of the benefits paid to this claimant.
7. [ ] The wage credits this claimant earned in your employ are not usable, therefore, there will be no charge against your experience rating account at this time.
8. [ ] The notice sent to you on ________ provided protest rights only if the claimant worked for you after ________ The previous determination remains in effect.
9. [ ] This refers to the separation information you furnished on ________ As the claimant's present unemployment results from a labor dispute, there will be no charges to your experience rating account at this time. We will issue a determination if the claimant files at a time when he is not involved in a labor dispute.
10. [ ] The attached Notice to Employer is unsigned; therefore, it is not a valid protest. If you wish to protest payment of Unemployment Insurance to this individual and/or charges to your experience rating account, please sign and return the form to us postmarked within seven days from the date of this letter.
11. [ ] Our records show that you reported earnings for this claimant for the period ending ________, which is in the base period.
*12. [ ] The claimant states he worked for you after ________, the date of our last notice. Since you did not furnish information on this claimant's most recent separation, charges will be made to your experience rating account for Unemployment Insurance benefits paid to this claimant.
13. [ ] The attached Notice to Employer is returned as there is no provision for relief of charges to a Base Period employer who elected payments in lieu of contributions, as provided for in Section 23-750, ARS.
14. [ ] Since the claimant was not employed by you during his base period, a determination of charges to your account will not be made until either the claimant's employment is terminated or you become subject to charges.
15. [ ] We have investigated and determined the claimant was not employed by you. Our records are being revised accordingly. 16. [ ] Your experience rating account will not be charged for any benefits paid to this individual since the employment was under the Federally funded CETA/PSE Program.
17. [ ] Other: ________
*NOTICE: When an asterisked item is checked, this notice is a determination which becomes final unless an appeal is filed within 15 days after the date of this letter. If the last day of the 15-day period falls on Saturday, Sunday, or a holiday, the period will be extended to the next working day. An appeal may be filed in person or by mail.
