RE: [REDACTED] - SOURCE
---
On May 1, 1972, I talked to SA RICHARD GALLAGHER
at the Bureau. He wanted to know why the USA only wanted
to file ITSP charges. I told him that we had discussed
this with the USA, and while technically they could file
FBW as well as ITSP charges, he felt it was best to file
the one and then if we wanted to add the other we could
do so in the indictment.
He reminded me of Mr. HENRY PETERSON's interest
in this case and suggested that Mr. PITKIN contact PETERSON
about it. I told him that Mr. PITKIN, per Mr. PITKIN's
earlier call, was going to talk to PETERSON about a defacto
immunity for FLEMING concerning [REDACTED] not delivered
by [REDACTED] to the New York Agents. These two tapes were made
by FLEMING in his original interviews with [REDACTED] and were
illegal under California law but legal under Federal law.
I told him that PITKIN was talking to [REDACTED] about them
and that they would very likely be delivered to New York today.
