Old Skyjack Indictment In

WASHINGTON (AP) — A federal grand jury late Wednesday returned an air piracy indictment in the case of the man known as Dan Cooper who parachuted from an airliner with $200,000 on Thanksgiving Eve in 1971, the Justice Department an- nounced.

The indictment, naming a fictitious "John Doe also known as Dan Cooper," was returned in Portland, Ore.

An official familiar with the case said the indictment was obtained by the govern- ment as a precaution because of uncertainty over whether the five-year statute of limitations applied in the aerial hijacking case.

One count of the indict- ment charges aircraft piracy, and a second alleges obstruc- tion of interstate commerce by extortion.

Both the Justice Depart- ment and the FBI say there are several reasons why the normal statute of limitations would not seem to apply. Although they doubt he sur- vived, they say they will look for Cooper and the money until they find him or de- termine that he is dead.

The Justice Department takes the position that there is no statute of limitations on capital crimes, and that what Cooper did was a capital crime, punishable by death, at the time he did it.

The official in Washington noted that a Justice Depart- ment attempt earlier this year to prosecute New Jersey Teamster leader Anthony Provenzano and others in con- nection with the 1961 kidnap- slaying of another union of- ficial was thrown out of court by a federal judge who ruled that the statute of limitation had expired a decade ago.
